Default Starter bendix sticking open

My new starter bendix drive gear sticks when retracted to it's normal state.

the starter works fine... it's the bendix, it seems to be the threads that get jammed together on return of the gear.
can this be repaired by any simple means ?

Which style drive is it?

Some drives lock in until the engine spins them out of engagement.

it's for a 1930 it's a Stock style reproduction bendix.
to Clarify, the gear is sticking in the disengaged position.

The shaft is straight.

I found an old Original Bendix, with Bendix brand labeled cap screws.

Differances:
A.) on the original, the square treads in the shaft are cut much deeper.
B.) there is a little/tiny set screw with spring pressing outward on the gear
C.) the gear engagement location and offsets are different.
D.) the orig has no light return spring. ( maybe gone )
F.) New shaft threads taper out at the end, instead of being mill cut.

Are you using any lubricant or grease on the spiral? They should be CLEAN & DRY.

Notice in your last picture how the ends of the original spring are wrapped tighter for a close fit, while the new repro spring is a very sloppy fit. Bratton's and probably others sell shims to take up that loose fit.

The threaded locking collar on the new drive is too thick and barely lets the drive engage. Notice the engagement mark in the first picture.

You say it locked out, but your picture shows it in the engaged position. Maybe it binds in the out position due to a tight helix fit to the pinion.
