Re: Bought parts on the Barn
Quote:
I'm trying to recall, but I don't think it went down like that. The court said they were going to try to track the guy down. I followed up with the Sheriff's office and they said something like the guy can't pay so you'll need to file a lean against him which had a fee attached to it which I had to pay. I remember the judge being a real jerk and his attitude was like, oh well. Like I said, I was young, 20-ish, and it started to add up costing me money to get my money from the guy. Day off work, filing cost, etc. I gave up since it wasn't worth my time or expense any at that point. I learned my lesson and I have done things different since then. |

Re: Bought parts on the Barn
Your right, it can be a pain, but just a while back $1000 was like $7000 today. But if you would have had to hire a skip tracer you would only be working for justice and peace of mind, not money.

Re: Bought parts on the Barn
I don't think at this point it would be beyond naming the person. They can respond.
My understanding Ryan isn't going to babysit every sale. Life happens also, they might have issues we don't know and someone else might. or know the seller from another sale. It is a bit of money to not make light of. Talking tough on the web isn't going to do anything. |

Re: Bought parts on the Barn
It was stated Delaware earlier on. If it's who I think it is, I'm hopeful he'll come through in the end. I've done business with the person I'm thinking of and it all went well. Things are weird right now.

I agree with Kryon 32, in Nebraska unless the laws have changed all the small claims court will do is provide a judgement, then an attorney enters the picture.

Re: Bought parts on the Barn
A judgment allows a type of lien and a bit of grief on the losing party. I wasn't paid on a claim till years later when the other guy wanted to buy a house. Maybe this guy will make things right, lots of things right now can slow communications, maybe he can't breath too well. I wouldn't use a lawyer for a small claims judgment, maybe a collection agency.

Re: Bought parts on the Barn
He might be trying to resell the parts to come up with the money he payed you. Not the best way to honor a transaction but if he spent the parts money that you sent him already then this may be his only option.

Re: Bought parts on the Barn
Hopefully the seller learned as much as the buyer in this situation. A seller should make sure the buyer is getting what he thinks he is getting before the next deal is done. It can be difficult to do business with folks that aren't as up front as they should be. Photographs and good communication between parties can't be stressed enough when a fair amount of monetary funds are on the line. Most folks are relatively honest about things in the old car hobby but there are always exceptions to the rule. When a person states one thing and it ends up being something else then the old caveat emptor kicks in.

Rotorwrench:
I agree 100%. In this day and age with cell phones, it is easier than ever to send pictures. Whenever I see an ad that says "no picts", I keep moving. It as much for the seller's benefit as the purchaser. |

Best of luck Gary . . . hope this all works out - for everybody on the Barn! (Including the seller).
