Default Bought parts on the Barn

I'm asking how to handle a purchase of parts on the Barn. The parts were not as described. Parts cost 1400.00. I contacted the seller who said he would refund my money when I returned the parts which I did. That's been several weeks ago and nothing. I'm not a person who outs someone so I guess I'm screwed?

I agree with contacting Ryan ……I also agree with you about waiting to divulge their identity….although it does help others to avoid them..does the person answer any inquiries from you?……Sorry to hear this…I’ve dealt with you before and consider you an honorable business man…..Mark

Well, there is always the Covid excuse. I agree with allowing ample time for a proper response. However, it looks like that date should be fast approaching. So, for the sake of other, potential, victims and while this is still relevant a declaration might be in order. Only my opinion and not worthy of significant consideration.

File the claim at your home county court. He is then responsible for appearing in that court, in one way or another, or forfeiting the case. Of course it isn’t over with the judgement, so you may still need to attach his income source.

Possibly you might contact the local PD and speak to a detective in his local town....."maybe" he would go pay him a face to face visit. I say this because this is "exactly" what happened for me and one other Barner' many years ago when we got scammed on a Pines Winter front. Maybe it was because there were two of Us BUT the local Calaveras Co detective paid him a visit and we ended up getting 95% of our money back (part cost...NOT shipping) BUT as the detective told Us be happy/satisfied with what we got AS he "really" had no ground to stand on "legally" to get him to do what he did SO....fingers crossed this "MAY" work for you too IF you can find a willing accomplice.

What method did you use for payment? If it involved the mail, this would be considered mail fraud and you can file with the U.S. Postal Inspection Service. It's a federal crime.

https://postalinspectors.uspis.gov/

If you solely used the internet, it's a crime you report to the FBI's Internet Crime Complaint Center (IC3). Internet crime is also a federal offense.

Or, I know using the long distance telephone to commit a fraud is a crime so I can't imagine that using the internet to commit a fraud isn't. I hate a cheat. Give him 30 days and go for it.

I hope you have proof of delivery upn return of the items.

I have the canceled check I used for payment to him and the UPS tracking information that shows he received the parts. I've dealt with USPS in the past on other matters and it usually ends up in a dead end.

Has he communicated with you since the parts were returned? Do you have proof that they were returned and accepted?

I would give him a couple more weeks and if he has not contacted you - then consider further action. When folks suddenly go silent, it is usually a very bad sign . . .

Hopefully this gets squared away - it is bad for ALL of us if a Barner screws another Barner.

In my one time experience with small claims court, the other guy didn't show. The judge was like, sorry, dude, can't get blood from a stone type of ruling.

I'm not an attorney and I was young person at the time, but it all went no where and I was out the $1,000 I was owed at the end.

I wish you luck and I'd assume doing a deal out of state complicates things tremendously. I hope it all works out.

I built a carb for a guy in Grantville Pa.......rushed it to him before rec'g payment.
I went thru some frustrating steps which yield zilch. I recalled that Zach Suhr, long
term Barner, lived near Grantville. Zach got nowhere with this turd, after a quick session
Zach got the PA State Police involved. One visit from them scared this guy straight.
Got an envelope with cash by weeks end.

A no show gave you the win in small claims. You were too young then. A judgement stays on a persons credit until you are paid. Some day he will want to buy something. You may have had to do some additional filing though.

Not completely correct.I believe a judgment has to be renewed every 7 years or so. I am no lawyer, but I have won 2 times in small court. After you win, you have to pay the sheriff every time he goes to the guy's bank to try and collect. No funds in the account, no matter, you pay anyway, and I believe it gets added to the bad guy's bill, which you will most likely never get anyway. 2nd one, the guy could not get a mortgage until he cleaned up the judgement. He offered me half, which is better than the nothing I had been getting, so I took it. I am sure every state is different, but the main point is, a judgement is pretty worthless

I'm trying to recall, but I don't think it went down like that. The court said they were going to try to track the guy down. I followed up with the Sheriff's office and they said something like the guy can't pay so you'll need to file a lean against him which had a fee attached to it which I had to pay. I remember the judge being a real jerk and his attitude was like, oh well.

Like I said, I was young, 20-ish, and it started to add up costing me money to get my money from the guy. Day off work, filing cost, etc. I gave up since it wasn't worth my time or expense any at that point.

I learned my lesson and I have done things different since then.

Your right, it can be a pain, but just a while back $1000 was like $7000 today. But if you would have had to hire a skip tracer you would only be working for justice and peace of mind, not money.

I don't think at this point it would be beyond naming the person. They can respond.

My understanding Ryan isn't going to babysit every sale.

Life happens also, they might have issues we don't know and someone else might. or know the seller from another sale. It is a bit of money to not make light of.

Talking tough on the web isn't going to do anything.

It was stated Delaware earlier on. If it's who I think it is, I'm hopeful he'll come through in the end. I've done business with the person I'm thinking of and it all went well. Things are weird right now.

I agree with Kryon 32, in Nebraska unless the laws have changed all the small claims court will do is provide a judgement, then an attorney enters the picture.

A judgment allows a type of lien and a bit of grief on the losing party. I wasn't paid on a claim till years later when the other guy wanted to buy a house. Maybe this guy will make things right, lots of things right now can slow communications, maybe he can't breath too well. I wouldn't use a lawyer for a small claims judgment, maybe a collection agency.

He might be trying to resell the parts to come up with the money he payed you. Not the best way to honor a transaction but if he spent the parts money that you sent him already then this may be his only option.

Hopefully the seller learned as much as the buyer in this situation. A seller should make sure the buyer is getting what he thinks he is getting before the next deal is done. It can be difficult to do business with folks that aren't as up front as they should be. Photographs and good communication between parties can't be stressed enough when a fair amount of monetary funds are on the line. Most folks are relatively honest about things in the old car hobby but there are always exceptions to the rule. When a person states one thing and it ends up being something else then the old caveat emptor kicks in.

Rotorwrench:

I agree 100%. In this day and age with cell phones, it is easier than ever to send pictures.

Whenever I see an ad that says "no picts", I keep moving. It as much for the seller's benefit as the purchaser.
