Default Bought parts on the Barn

I'm asking how to handle a purchase of parts on the Barn. The parts were not as described. Parts cost 1400.00. I contacted the seller who said he would refund my money when I returned the parts which I did.That's been several weeks ago and nothing. I'm not a person who outs someone so I guess I'm screwed?

Small claims court might work locally but Nebraska to Delaware is like p---ing in the wind.

Well, there is always the Covid excuse. I agree with allowing ample time for a proper response. However, it looks like that date should be fast approaching. So, for the sake of other, potential, victims and while this is still relevant a declaration might be in order. Only my opinion and not worthy of significant consideration.

File the claim at your home county court. He is then responsible for appearing in that court, in one way or another, or forfeiting the case. Of course it isn’t over with the judgement, so you may still need to attach his income source.

Possibly you might contact the local PD and speak to a detective in his local town....."maybe" he would go pay him a face to face visit. I say this because this is "exactly" what happened for me and one other Barner' many years ago when we got scammed on a Pines Winter front. Maybe it was because there were two of Us BUT the local Calaveras Co detective paid him a visit and we ended up getting 95% of our money back (part cost...NOT shipping) BUT as the detective told Us be happy/satisfied with what we got AS he "really" had no ground to stand on "legally" to get him to do what he did SO....fingers crossed this "MAY" work for you too IF you can find a willing accomplice.

What method did you use for payment? If it involved the mail, this would be considered mail fraud and you can file with the U.S. Postal Inspection Service. It's a federal crime.

Or, I know using the long distance telephone to commit a fraud is a crime so I can't imagine that using the internet to commit a fraud isn't. I hate a cheat. Give him 30 days and go for it.

I hope you have proof of delivery upn return of the items.

I have the canceled check I used for payment to him and the UPS tracking information that shows he received the parts. I've dealt with USPS in the past on other matters and it usually ends up in a dead end.

Has he communicated with you since the parts were returned? Do you have proof that they were returned and accepted?

I would give him a couple more weeks and if he has not contacted you - then consider further action. When folks suddenly go silent, it is usually a very bad sign . . .

Hopefully this gets squared away - it is bad for ALL of us if a Barner screws another Barner.

In my one time experience with small claims court, the other guy didn't show. The judge was like, sorry, dude, can't get blood from a stone type of ruling.

I'm not an attorney and I was young person at the time, but it all went no where and I was out the $1,000 I was owed at the end.

I wish you luck and I'd assume doing a deal out of state complicates things tremendously. I hope it all works out.

I built a carb for a guy in Grantville Pa.......rushed it to him before rec'g payment.
I went thru some frustrating steps which yield zilch. I recalled that Zach Suhr, long
term Barner, lived near Grantville. Zach got nowhere with this turd, after a quick session
Zach got the PA State Police involved. One visit from them scared this guy straight.
Got an envelope with cash by weeks end.
When in someones cross hairs don't jerk around take care of business....no excuses
run his name on the flag pole. Otherwise you are enabling him

A no show gave you the win in small claims. You were too young then. A judgement stays on a persons credit until you are paid. Some day he will want to buy something. You may have had to do some additional filing though.

Not completely correct.I believe a judgment has to be renewed every 7 years or so. I am no lawyer, but I have won 2 times in small court. After you win, you have to pay the sheriff every time he goes to the guy's bank to try and collect. No funds in the account, no matter, you pay anyway, and I believe it gets added to the bad guy's bill, which you will most likely never get anyway. 2nd one, the guy could not get a mortgage until he cleaned up the judgement. He offered me half, which is better than the nothing I had been getting, so I took it. I am sure every state is different, but the main point is, a judgement is pretty worthless
