On my '38, your '40 should be similar, I mounted it on the outside of the frame rail under the left front fender. It is convenient to change, and more importantly to me, the lines to/from the filter are below the ports on the engine so the oil in the lines doesn't drain back into the engine to have to be refilled at startup.
