In the US, in most states, there are (at least*) two different insurance agreements. First, is the one that you pay your insurer for damages to your property. This is usually limited by your insurance agreement. The second is the insurance you pay for damages you cause to another (or they paid for damages to you). And while the liability companies in the US will lie about limits and what can be done ultimately there is a right to go before a judge and the judge sets the amount (of course if you get greedy that might be less than what the other guys insurance might have paid).


You are dealing with a major property loss, where "value" is difficult to determine. Contact your lawyer (or solicitor, or whatever) for expert advise on what your rights are and the other parties responsibilities are.


*In Oregon at least two more, Injury insurance which is pooled among all involved without regards to fault, and "un-insured motorist" which partially covers what would be a liability claim against the other guy when they do not have insurance.
