Someone certainly could not do this with a Walt Disney theme without express permission.

Interestingly in the model railroad industry, manufacturers of toy trains have been using railroad trademarks so long without paying that the railroads have lost the right to enforce them.
BTW I own about 1 millionth of the Ford company (stock)

Funny thing, A child care center had the Disney characters on the walls of the center. Disney found out are had papers served to stop and over paint the pictures. Once it made the local papers, Universal Studios sent their animators to the center and painted all their cartoon characters free of charge. Check and mate!
