This is a crock. The part was never purchased by
lazlobassett as new but was used when he got it. Bill, Brent and Will have it right. When you buy a part from anyone other than the manufacturer or his representative you get what you get. Generally speaking, warranties are not included with the purchase of a used part unless specifically stated by the original manufacturer or seller.
lazlobassett got ripped off by the guy he bought the car from, not Dan. I know Dan personally and can attest to the impressions others had at first meeting, he is a jerk. Once you have time to get to know him, he is a good guy and will help in any way he can as long as it is right whether it is in his best interest or not.
Buck up and admit it, you got took by the seller of the car. Go get your restitution from him!
