Apparantly there's a little pad that goes between the hold down and the battery. I wonder if OEM 1940 Ford batterys had a wider top edge to accommodate that hold down mechanism?

I know it's not OEM correct but I just made a plastic spacer with a threaded hole and wedged it in between my firewall clamp and battery top. Many years ago someone brazed the firewall clamp in place so it's not movable. I never noticed it had been done. This car has been converted to 12V Neg. grnd. so battery cables are switched. Here's another site that shows the 1940 battery hold down pad.
