So I saw a nice original 56 F-100 on ebay and bid, I won with a 4900 bid. Waited 24 hours for a response. I was told that I did not win because he forgtot to put a reserve on it. What do I do. Have already spent 200 on finding a shipper.

You can't do anything. In practical terms even with an ebay auction you have to have a willing seller and buyer. You don't have a willing seller. Better luck next time. Complain to ebay. They will tell you the same thing.

It is his bad luck for not putting a reserve on it. Make him sell it to you as you are high bidder. He should be more careful. If your bid was a reasonable bid for the item up for auction, I think you can make him stand by the deal. (Retired Attorney)

A year or so ago I saw a beautiful white '34 cabriolet listed for a goofy "buy it now " price. I knew it was either a scam or a mistake. I was very tempted to hit the "buy it now" button since I was the second viewer of the car but decided to contact the seller. It was a listing error on his part and he corrected it immediately.For less than $20,000 I could have "had" a $70,000 car that is still occasionally listed there. I felt that I did the right thing. Winning a auction that had an error in the listing is one thing, getting them to follow through is something else. Winning a judgement in court these days means nothing unless you have the means to enforce the judgement. In most cases the only one's to emerge victorious are the lawyers.

As per eBay's terms (you'd have to read the fine print) some auctions are legally binding, but car auctions are not.

I suppose this is why many sellers attempt to create a legally binding contract by stating that the winning bid buys the car, or words to that effect.

The only thing to do is to report the issue to Ebay and give the guy bad feedback. I saw the 56 F-100 listing and the completed auction and truthfully you may be lucky,the guy had 0 feedback,usually this is a red flag that it is a scam.

How did shipping cost you $200 already when you have had nothing shipped? You hadn't even heard from the seller, so what did the shipping company charge you for in that first 24 hours?

Next time he re-listed it, I would bid it up high to win the auction, then give him some of his medicine back. No action against you. Cause eBay would look at the first time he listed it and who won that one. G-man

I guess you could use some sort of legal action to force the sale but by the time you got your hands on the truck it would be stripped of everything of value not to mention the pound of sugar in the gas tank. I imagine loosing $200 (I am assuming that it is a deposit), leaves a bad taste in your mouth but in the long run you may be ahead of the game considering the downside.

As for eBay, you can complain and eBay will probably terminate the guy's account. In a couple of weeks he could open a new account with a different identification and start all over again.

As to losing your $200.00 deposit to the shipper....It depends on whether the deposit went to a actual shipper, or a broker who would then procure a shipper who would agree to pick up on a certain date. At any rate, if you gave the shipper a credit card deposit, you can put it into contest, and will probably get your deposit back. This happened to me with 3 different brokers who took my deposit but could not deliver a pick-up date. Good luck.

If your $200 went for a deposit and you went thru paypal you can contact them and they may be able to help get your money back. If it went to a shipper for a reservation you may be out of luck.
Having sold a few big ticket items on the auction site I can tell lots of storys about the things that you run into.

My leason learned .... don't use eBay to set-up auto shipping. That process typically takes you to a low-bidding "company". That company will likely turn out to be an "arranger". Next comes a "trucking broker" who takes bids from the real truckers. Starting at the top with eBay, they each take a "fee" or "deposit". I paid $560 total. The trucker who brought me my purchase was paid $275.
